Morrison Bowmore Distillers Limited encourage you to drink
responsibly.
1. WHO ARE WE?
We are Morrison Bowmore Distillers Limited, a company incorporated
under the laws of Scotland, with company number is SC119227 and a
registered office, and principal place of business, at Springburn
Bond, Carlisle Street, Glasgow G21 1EQ. In these terms and
conditions of sale Morrison Bowmore Distillers Limited is referred
to as "we", "us" or "our".
2. WHAT ARE THESE TERMS AND CONDITIONS AND WHAT DO THEY
APPLY TO?
2.1 These terms and conditions of sale apply to the goods you order
from our website at www.morrisonbowmore.co.uk (in these terms and
conditions of sale goods you order from our website are referred to
as "Goods").
2.2 We recommend that you print these terms and conditions off or
save them to your computer so that you have a record of them.
3. WHERE DO WE DELIVER?
We will deliver Goods to addresses in the European Union
only.
4. YOU MUST BE OF LEGAL AGE TO BUY ALCOHOL
You must be of legal age to buy alcohol in the country you are
situated in order to buy alcoholic Goods from us. If you are buying
alcoholic Goods for someone else, the addressee that we deliver to
must also be of legal age to buy alcohol.
5. WHAT INFORMATION WILL WE GIVE TO YOU PRIOR TO YOU
PLACING AN ORDER OVER OUR WEBSITE?
Prior to your placing an order over our website, we will provide
you with the following on screen information:-
5.1 our name and address;
5.2 a description of the Goods together with an indication of the
quantity of Goods you are ordering;
5.3 the total price for all the Goods making up your order (in
pounds Sterling), including any applicable taxes in the UK;
5.4 details of any delivery costs for your order; and
5.5 arrangements for payment or delivery.
6. HOW YOU CAN PAY
We accept the following payment methods for your order over our
website: MasterCard, Maestro, Visa and their derivatives, Switch,
Maestro, Delta and Solo. By submitting your card details to our
website you agree to authorise us to debit or charge the price of
the Goods you have ordered (including all applicable taxes and
delivery charges) on or from your credit card, debit card or bank
account.
7. AFTER YOU PLACE AN ORDER OVER OUR WEBSITE
7.1 Once you have submitted your order to us over our website you
will receive an email confirming that we have received your order
and we will tell you at that time, or in a further email, whether
or not we have accepted your order. Our email will include the
following information:-
7.1.1 how to exercise your right to cancel, including how to return
any Goods delivered to you if you choose to cancel your order up to
and including the date 7 days after the date we deliver the Goods
to you (for further details see our "Returns Policy" at Paragraph 9
below);
7.1.2 our address should you have any complaints.
7.2 We will process your payment once we have accepted your
order.
7.3 We will let you know if there are any problems in processing
your order, for example if there is any delay in delivering the
Goods owing to the Goods being temporarily unavailable. In the
event that the Goods are likely to be unavailable for longer than a
reasonable time:
7.3.1 if we have not yet accepted your order we will contact you to
offer you an alternative product or not accept your order; or
7.3.2 if we have accepted your order and we have already received
payment from you, we will contact you to offer you an alternative
product or provide you with a full refund.
8. DELIVERY
8.1 We will try to deliver the Goods within 10 working days but we
cannot guarantee delivery within that time.
8.2 We will deliver the Goods to you by courier. Please ensure that
the address you have given us for delivery is one that can be used
for daytime delivery.
9. RETURNS POLICY
9.1 You are entitled to cancel your order up to and including the
date falling 7 days after the date we deliver the Goods to you. We
will refund the price of the Goods (including all applicable taxes
and delivery charges) to you provided we receive notice from you
within the 7 day period and provided you return the Goods to us
within 30 days of the date that you placed your order to our
website.
9.2 To notify us that you do not wish to keep the Goods and wish to
cancel your order you must either:-
9.2.1 notify us on telephone number +44 (0) 141 558 9011 during our
office hours of 9am to 5pm UK time, Monday to Friday (excluding
public holidays); or
9.2.2 email us at weborders@morrisonbowmore.co.uk; or
9.2.3 write to us at Springburn Bond, Carlisle Street, Glasgow G21
1EQ (please mark any correspondence for the attention of Web Shop
Returns Department).
9.3 If you decide to exercise your right to cancel within the 7 day
period, we will send you a pre-paid postage label for you to place
on the original packaging that we sent to you with the Goods and
then you must then take the Goods to a post office to return them
to us by post.
9.4 If you notify us within the 7 day period that you wish to
return the Goods, and we do not receive the Goods within 30 days
from the date when you submitted your order to our website, we
shall be entitled to uplift the Goods from you and we will refund
the price of the Goods (including all applicable taxes and delivery
charges) to your credit card, debit card or Maestro card account,
less a deduction for our costs in uplifting the Goods from
you.
9.5 You may not exercise your right to cancel your order and return
the Goods to us if you have opened the bottle, broken the seal or
have otherwise tampered with or damaged the bottle in any way. If
you return any bottle which has been opened, which has the seal
broken or is damaged in any way then we will not accept the return
of such a bottle and will not make any refund to you. This does not
affect your rights under Paragraph 9.7 below.
9.6 Please note that you will have no right to cancel orders for
Goods which have been personalised for you as part of a special
offer we may run from time to time, for example if you have ordered
bottles from us that are to be engraved or marked bottles with your
name. This does not affect your rights under Paragraph 9.7
below.
9.7 Our returns policy does not affect your statutory rights in any
way. You are always entitled to return Goods to us which you
believe are damaged or faulty. If you believe the Goods delivered
to you are damaged or faulty then please contact us on telephone
number +44 (0) 141 558 9011 during our office hours of 9am to 5pm
UK time, Monday to Friday (excluding public holidays) and ask for
our Web Shop Customer Care Department.
9.8 If you have any questions about our Returns Policy, please call
us on + 44 (0) 141 558 9011 during our office hours of 9am to 5pm,
Monday to Thursday and 9am to 2.30pm Friday, UK time or email us at
weborders@morrisonbowmore.co.uk.
9.9 Please quote your name, address, delivery address and order
number when calling us or emailing us regarding a return. This
information will help us to process your enquiry as quickly as
possible. If you are returning Goods because they are damaged or
faulty please specify in what way you believe the Goods are damaged
or faulty.
10 USE OF PERSONAL INFORMATION
We will only use the personal information that you provide to us
over our website for the purposes of processing your order,
delivering the Goods and processing any returns. We will not use
your personal information, or any personal information relating to
the addressee (if the addressee is not you) for any other purposes,
unless you specifically give us authorisation to do so. For more
information, please see our Privacy Policy located on our
website.
11. LOCAL DUTIES AND TAXES
The total price we charge you for the Goods in your order includes
all applicable taxes payable in the UK. If you are situated outside
the United Kingdom, there may in addition be an obligation to pay
local taxes, duties, value added tax, charges or other levies
imposed in your country. We will not be responsible for paying any
such local taxes, duties, value added tax, charges or other levies
imposed in your country. You will be responsible for payment of
such sums, and we will not be responsible if your failure to pay
any such sums prevents or delays us from delivering the Goods to
you.
12. GENERAL
12.1 We will communicate with you in the English language only. All
notices, orders and other communications made to us by you must
also be in the English language.
12.2 If any provision of these terms and conditions is held by any
court or other competent body to be invalid or unenforceable in law
then the provision in question shall be omitted or amended in such
a way as to be enforceable while giving effect to the intention of
the provision and the other provisions shall not be affected.
12.3 These terms and conditions shall be governed by the laws of
the Scotland and the courts of Scotland shall have non-exclusive
jurisdiction.
